Introduction

This purchase is governed by the following standard terms and conditions for consumer purchases of goods over the Internet. Consumer purchases via the internet are primarily regulated by the Norwegian Contracts Act, the Consumer Purchases Act, the Marketing Control Act, the Right of Withdrawal Act, and the E-commerce Act. These laws provide consumers with non-waivable rights and can be found at www.lovdata.no.

These terms do not limit your statutory rights, but outline the main rights and obligations of both parties in the transaction. These conditions are prepared and recommended by the Norwegian Consumer Authority.


1. The Agreement

The agreement consists of these terms and conditions, the information provided during the checkout process, and any additional individually agreed terms. In the case of conflicting information, specifically agreed terms shall prevail, provided they do not contradict mandatory law.

The agreement is further supplemented by relevant legal provisions governing the purchase of goods between businesses and consumers.

The buyer is the consumer placing the order and is hereinafter referred to as the buyer.


3. Price

All prices listed in the online store are exclusive of VAT unless otherwise stated.

The total cost, including all taxes (VAT, customs duties, etc.), shipping charges (freight, postage, invoice fees, packaging, etc.), and a breakdown of the components of the total price, will be clearly stated during the checkout process before the order is placed.


4. Conclusion of the Agreement

The agreement becomes binding when the buyer submits their order to the seller.

However, if there is a typographical or input error in the seller's offer or in the buyer's order, and the other party realized or should have realized that such an error occurred, the agreement is not binding.


5. Payment

The seller may charge for the goods once they have been shipped to the buyer.

If paying by credit or debit card, the seller may reserve the amount on the card at the time of ordering. The card is charged on the same day the goods are shipped.

If paying by invoice, the invoice is issued upon shipment. The due date is stated on the invoice and is at least 14 days from receipt.

Buyers under 18 years old may not pay via post-purchase invoice.


6. Delivery

Delivery takes place as described during checkout: method, location, and time.

If no delivery time is stated, the seller shall deliver within a reasonable period, no later than 30 days after the order is placed. If the seller arranges shipping, the item will be delivered to the buyer's address unless otherwise agreed.


7. Risk of the Goods

The risk passes to the buyer when the goods are received. If the buyer does not accept the item at the agreed time, the buyer still bears the risk for loss or damage due to the item’s nature.


8. Right of Withdrawal

Unless the agreement is exempt from the right of withdrawal, the buyer may cancel the purchase within 14 calendar days from:

  • The day after receiving a single item purchase.
  • The day after receiving the first delivery in a subscription or regular delivery arrangement.
  • The day after receiving the final delivery in multiple-part shipments.

Notice of withdrawal must be sent before the deadline expires. It is advisable to submit notice in writing (email or form). The buyer must return the goods no later than 14 days after giving notice and is responsible for return shipping costs unless otherwise stated.

The seller will refund the purchase amount without undue delay and no later than 14 days from receiving the withdrawal notice. The seller may withhold the refund until the goods are returned or proof of return is provided.


9. Delay or Non-Delivery – Buyer's Rights

If the seller fails to deliver as agreed, and the issue is not due to the buyer, the buyer may withhold payment, demand delivery, cancel the agreement, and/or claim compensation as per Chapter 5 of the Consumer Purchases Act.


10. Defective Goods – Buyer's Rights and Complaint Deadline

If the goods are defective, the buyer must notify the seller within a reasonable time after discovering (or when they should have discovered) the defect to claim their rights.


11. Seller’s Rights in the Event of Buyer’s Breach

If the buyer fails to pay or fulfill other obligations, and this is not due to the seller, the seller may withhold delivery, demand performance, cancel the agreement, and/or claim compensation.


12. Warranty

Warranty is provided only if specified during checkout or in product details. Otherwise, statutory consumer rights apply.


13. Personal Data

The seller is the data controller for collected personal data. Unless otherwise agreed, only data necessary for fulfilling the agreement will be collected and stored. All handling of data complies with applicable privacy legislation.


14. Dispute Resolution

Complaints should be addressed to the seller within a reasonable timeframe. The parties shall aim to resolve any disputes amicably.
